Terms of Service.

The agreement between you and Simonina — written to be read.

Draft. This is honest working copy, pending review by counsel before launch. Treat it as a good-faith description of how we intend to operate — not yet a final, binding agreement.

1. Welcome

These Terms of Service (“Terms”) govern your use of Simonina — our websites, apps, and the AI companions you talk to (together, the “Service”), provided by Simonina (“we,” “us”). By creating an account or using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.

2. Who can use Simonina

Simonina is made for adults. You must be at least 18 years old (or the age of majority where you live, if that’s higher) to create an account or use the Service. By using Simonina you confirm that you meet this requirement. The Service is not intended for, and is not directed to, anyone under 18, and we don’t knowingly allow them to use it.

3. Your account

You’re responsible for your account and for keeping your login credentials secure. Please give us accurate information when you sign up, and let us know if you believe your account has been used without your permission. You may close your account at any time.

4. Acceptable use

By using Simonina, you agree not to:

  • use the Service for anything unlawful, or to harm, harass, or impersonate others;
  • attempt to create, request, or share content that sexualizes minors, or that depicts real, identifiable people without their consent — this is strictly prohibited and not negotiable;
  • try to break, overload, reverse-engineer, or gain unauthorized access to the Service or its systems;
  • resell or commercially exploit the Service without our written permission.

We may remove content or suspend accounts that violate these rules. Serious or illegal abuse may be reported to the appropriate authorities.

5. Your companions and AI-generated content

Simonina’s companions are AI. They are not real people, and the conversations and images they generate are AI-generated fiction, even when they feel personal. The companions can be wrong, and what they say doesn’t represent our views. You’re responsible for how you use what the Service generates.

6. Content and ownership

The companions you create and the things you write are yours. You grant us the limited permission we need to operate the Service — for example, to store your content, generate replies, and keep your companion’s memory consistent over time. We own the Service itself, including our software, models, and brand.

7. Subscriptions, billing, and refunds

Parts of the Service may be free, and others may require a paid subscription. Pricing, billing cycles, and any refund or cancellation terms will be shown clearly before you pay. You can cancel a subscription at any time; cancellation stops future charges and takes effect at the end of the current billing period.

8. Privacy

How we handle your information is described in our Privacy Policy, which is part of these Terms. In short: we keep what matters to your companion’s memory and don’t treat your conversations as an archive to mine.

9. Not professional advice, not a crisis service

Simonina is a companion, not a medical, mental-health, legal, or financial professional, and it is not an emergency or crisis service. Don’t rely on it for those. If you’re in crisis or thinking about harming yourself, please contact your local emergency number or a crisis line right away.

10. Disclaimers and limitation of liability

The Service is provided “as is.” We work hard to make it reliable, but we can’t promise it will be uninterrupted or error-free. To the fullest extent the law allows, we’re not liable for indirect or consequential damages arising from your use of the Service.

11. Suspension and termination

You may stop using Simonina and delete your account at any time. We may suspend or end access if these Terms are violated, or if we need to for legal or security reasons. We’ll act reasonably and, where appropriate, give you notice.

12. Changes to these Terms

We may update these Terms as the Service evolves. If we make material changes, we’ll let you know through the Service or by email, and your continued use after the changes take effect means you accept the updated Terms.

13. Governing law

The governing law and dispute-resolution terms will be specified here once finalized with counsel.
